Builder Agreement

1. Appointment

The Company appoints the Associate as a non-exclusive Agent/Broker/Real Estate Consultant/Builder for listing and promoting rental properties through the Apna Ghar Rental Property platform.

2. Scope of Work

The Associate shall:

• Source genuine rental properties.
• Obtain the property owner's consent before listing.
• Submit accurate property details, photographs, rent, and availability.
• Maintain professional conduct with owners and tenants.
• Comply with all applicable laws and regulations.

3. Responsibilities

The Associate agrees that:

• All information provided is true and correct.
• No fake, duplicate, or misleading listings will be uploaded.
• The Associate shall verify ownership and authority before listing any property.
• The Associate shall not misuse the Company's name, logo, or brand.

4. Brokerage & Payments

1. Brokerage and commission shall be mutually agreed upon between the property owner, tenant, and the Associate unless otherwise specified by the Company.
2. Apna Ghar shall not be liable for any financial transaction between the parties.
3. Any membership or service fee payable to the Company shall be paid as per the applicable plan.

5. Confidentiality

The Associate shall keep confidential all customer information, business data, pricing, documents, and any proprietary information belonging to the Company and shall not disclose it without prior written consent.

6. Code of Conduct

The Associate shall:

• Maintain ethical business practices.
• Avoid misleading advertisements.
• Not engage in fraud or misrepresentation.
• Treat customers fairly and professionally.

7. Term and Termination

This Agreement shall remain effective until terminated by either Party by giving 30 days' written notice.

The Company may terminate this Agreement immediately if the Associate:

• Commits fraud.
• Uploads fake or unauthorized listings.
• Damages the Company's reputation.
• Violates any term of this Agreement.

8. Indemnity

The Associate agrees to indemnify and hold harmless the Company against any claims, losses, damages, penalties, or legal proceedings arising out of false information, negligence, fraud, or breach of this Agreement.

9. Limitation of Liability

Apna Ghar Rental Property is only a property listing and marketing platform and shall not be responsible for disputes regarding rent, deposits, brokerage, property condition, possession, ownership, or any transaction between the owner, tenant, and Associate.

10. Intellectual Property

The trade name "Apna Ghar Rental Property", logos, trademarks, software, website content, and marketing materials are the exclusive property of the Company and shall not be copied or used without written permission.

11. Governing Law & Jurisdiction

This Agreement shall be governed by the laws of India.

The courts having jurisdiction over Ahmedabad, Gujarat shall have exclusive jurisdiction to decide all disputes arising out of this Agreement.

12. Dispute Resolution

The Parties shall first attempt to resolve disputes through mutual discussion.

If unresolved, the matter may be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Ahmedabad, Gujarat, and proceedings shall be conducted in English.

13. Miscellaneous

• This Agreement constitutes the entire understanding between the Parties.
• Any amendment shall be valid only if made in writing and signed by both Parties.
• If any provision is held invalid, the remaining provisions shall continue in full force.
